The following are examples of times when you may be able to have an expedited hearing:

  • Compassionate allowances: If you have a serious illness, such as cancer, you may be able to obtain benefits more quickly. Social Security lists more than 200 illnesses that qualify for compassionate allowances.
  • Terminal illness: If you have a terminal illness with a life expectancy of six months or less, you can seek expedited approval.
  • Presumptive disability: For certain conditions, you are presumed to have a qualifying disability. Examples are Lou Gehrig's disease and a spinal cord injury that prevents you from walking without the use of a walker or two canes.
  • Dire need: If you don't have enough money for food, shelter or medical care, you may qualify for an expedited hearing due to dire need.
  • Military service: If your disability began while you were on active service, you may qualify for an expedited hearing.
  • OTR review: Depending on the medical evidence in your case, we may be able to request an on-the-record (OTR) review of your case from the administrative law judge without a hearing.
  • Attorney adviser decision: If we can show that Social Security made a mistake or you have new evidence to support your case, you can request a decision from an attorney employed by Social Security.
